•If you do not agree to these terms, please do not use this website or enroll in our programs.

•These Terms apply to all visitors, users, and enrollees. If you are enrolling a minor in a program, you represent that you are the parent or legal guardian of that minor and that you have the authority to agree to these Terms on their behalf.

1 Acceptance of terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and The Salty Sunflower Nature Collaborative, owned and operated by The Salty Sunflower Nature Collaborative LLC (“Company,” “we,” “us,” or “our”), located in San Diego, California.

By accessing this website, completing a purchase, or enrolling in any program, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. Your continued use of the website or participation in our programs constitutes ongoing acceptance of these Terms as they may be updated from time to time.

2 Intellectual property and copyright

All content on this website and in materials produced by The Salty Sunflower Nature Collaborative — including text, program descriptions, curriculum content, photography, graphics, the name “The Salty Sunflower Nature Collaborative,” and the Company logo — is the exclusive property of The Salty Sunflower Nature Collaborative and is protected by United States copyright law (17 U.S.C. §101 et seq.) and applicable trademark law.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without the prior written consent of The Salty Sunflower Nature Collaborative, except that you may:

•Store copies of materials temporarily in RAM incidental to your accessing and viewing those materials

•Store files that are automatically cached by your web browser for display enhancement purposes

4 Program enrollment and purchases

All program registrations and purchases made through this website are subject to the following:

4.1 Enrollment agreement. Enrollment in any Salty Sunflower program is not complete until all required enrollment forms have been signed and returned, all required health documentation (including vaccination records) has been received and verified, and payment has been received in full. A purchase receipt does not constitute final enrollment confirmation.

4.2 Payment. All prices are stated in U.S. dollars. Payment is processed through Squarespace’s commerce platform using Stripe or PayPal as the payment processor. The Company does not store your payment card information. By completing a purchase, you authorize the charge to your selected payment method.

4.3 Cancellation and refunds. Cancellations and refunds are governed by our Cancellation & Refund Policy, which is published at thesaltysunflowersd.com and incorporated into these Terms by reference. By completing a purchase, you agree to the Cancellation & Refund Policy in effect at the time of your purchase.

4.4 Program modifications. The Company reserves the right to modify, reschedule, or cancel any program session due to weather, air quality, safety concerns, insufficient enrollment, facilitator emergency, or other circumstances beyond our control. In such cases, families will be notified as promptly as practicable and a session credit or refund will be issued per our Cancellation & Refund Policy.

4.5 Participant eligibility. You represent that your child meets the age and health requirements for the program in which they are enrolled, and that all information provided in enrollment forms is accurate and complete. Knowingly providing false or incomplete health or enrollment information may result in immediate disenrollment without refund.

5 Health, safety, and assumption of risk

Our programs involve outdoor activities in natural environments and carry inherent risks as described in the program’s Liability Waiver. By enrolling your child, you acknowledge these risks and agree to the terms of the Liability Waiver, which is a separate legally binding document executed as part of the enrollment process.

You agree to notify the Company immediately of any changes to your child’s health, medications, allergies, or emergency contact information that occur after initial enrollment. The Company relies on the accuracy of the information provided to ensure participant safety. Failure to disclose material health information may result in disenrollment without refund.

6 Photography and media

Your child’s participation in any photography or video recording at Company programs is governed by the Photography & Media Consent Form completed as part of the enrollment process, and by our Photography & Media Policy published at thesaltysunflowersd.com. The Company will not use images or video of your child in any manner beyond what you have consented to in writing.

7 Privacy

Your use of this website and participation in our programs is subject to our Privacy Policy, available at thesaltysunflowersd.com. The Privacy Policy describes how we collect, use, store, and protect your personal information and the personal information of your child. By using the website or enrolling in a program, you consent to the data practices described in the Privacy Policy.

8 User-submitted content

If you submit testimonials, reviews, photos, or other content to the Company (by email, social media, or otherwise), you grant The Salty Sunflower Nature Collaborative a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, and display such content in connection with our programs and marketing, subject to our Privacy Policy and any applicable consent requirements for images of minors.

You represent and warrant that you own or control all rights to any content you submit, that the content is accurate, and that its use by the Company does not violate these Terms or any applicable law.

9 Disclaimer of warranties

THIS WEBSITE AND ALL CONTENT, PRODUCTS, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

• Your access to or use of (or inability to access or use) this website

• Any content obtained from this website

• Unauthorized access to or alteration of your transmissions or data

• Your participation in any Company program, to the extent not covered by the executed Liability Waiver

In no event shall the Company’s total liability to you for all damages exceed the amount paid by you to the Company in the twelve (12) months preceding the claim. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you.

11 Governing law and dispute resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms, this website, or any program enrollment shall be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

Before initiating any formal legal proceeding, you agree to first contact The Salty Sunflower Nature Collaborative in writing at admin@thesaltysunflowersd.com and allow the Company thirty (30) days to attempt to resolve the dispute informally.

12 Changes to these Terms

The Company reserves the right to update or modify these Terms of Use at any time. Changes will be effective immediately upon posting to this website. Your continued use of the website or participation in any program after a change is posted constitutes your acceptance of the revised Terms. We will update the “Last updated” date at the top of this page when changes are made. We encourage you to review these Terms periodically.

For material changes that affect your enrolled program or existing purchase, we will make reasonable efforts to notify you by email.

13 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

14 Entire agreement

These Terms of Use, together with the Privacy Policy, Disclaimer, Cancellation & Refund Policy, Photography & Media Policy, and any executed enrollment agreements and liability waivers, constitute the entire agreement between you and The Salty Sunflower Nature Collaborative with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, representations, and understandings.
